Chicago FF files lawsuit against Elkhart Brass

A Chicago firefighter named Michael Wielgat is taking legal action against Elkhart Brass and two of its executives, claiming they breached their contract to manufacture, promote, and sell a device he invented for tackling high-rise fires. The lawsuit also alleges that the company is attempting to claim the invention as its own.

The HERO (High-rise Emergency Response Offensive) Pipe is designed to attach to the windowsill or floor beneath a fire occurring above the 12th floor, where ladder trucks cannot reach with water. It extends a telescopic arm upward, allowing water to be directed precisely at the affected floor. Captain Wielgat came up with this idea back in 2004 after fighting a blaze at the 45-story LaSalle Bank building, which left many trapped above the 29th floor due to limited access for firefighters.

In 2007, his patent application was published by the U.S. Patent Office. By 2010, after extensive prototyping with both the Chicago and New York Fire Departments, the FDNY requested that the HERO Pipe include a remote-controlled or movable nozzle to adjust the water spray more effectively. Wielgat sought assistance from Elkhart Brass for such a monitor, and subsequent tests were successful. This led the FDNY to order four HERO Pipes. Around this time, Wielgat established Hero Systems Inc., and later that year, Elkhart Brass’ COO, Don Sjolin, approached him with an ambitious proposal to produce the product, predicting sales surpassing $1 million in the first year and growing rapidly thereafter. They formalized their agreement in April 2011.

However, unbeknownst to Wielgat, just prior to signing the agreement, Elkhart Brass had already filed patent applications under their own name for the HERO Pipe, listing Elkhart Brass employees Steve Bollinger, Curt McDowell, and Bruce Behenna as the inventors. The lawsuit claims that Elkhart Brass conspired with its executives to sabotage the promotion of the HERO Pipe, ultimately terminating the agreement on false grounds and subsequently marketing it as their own creation once the deal was over. Wielgat's compensation for expenses ceased in December, according to the lawsuit.

Hero Systems Inc.'s lawsuit was filed on January 9 in the northern Indiana U.S. District Court in South Bend.
