In early 2010, a company settled in Liuhe to carry out the bridge construction project, and built the Luan River Bridge and approach bridge over the ditch.

Because of the need of construction, the company must build a simple north-south road on the drainage ditch, and a water culvert buried under the road leading to the west side of the river. Due to the high buried position of culverts, water can easily accumulate in drains.

In order to meet the needs of mixing concrete for water intake, the company continued to dig downwards in the ditch next to the simple road. The company took a water intake pipe to facilitate water withdrawal. After the Spring Festival in 2012, a large amount of rainwater accumulated in the small water ditches and the east intake.

The simple road surface is about 1.5 meters away from the surface of the water. The surface of the water is steep, and the pits are uneven. There are no safety guards such as guardrails installed on both sides of the simple road.

At 3 pm on February 27th, 2012, the newlyweds Xiao Zhang and Xiaoli’s daughter spent the day with their grandmother’s arrival at the vegetable garden behind the house. When she was watching TV at home, she suddenly found out that her mother rushed in and yelled: "The flower is gone!"

Xiaoli found that the flower's clothes were all wet from the inside to the outside. At this time, she had lost consciousness. She placed the flowers on the concrete road in front of her house and rushed to the village doctor for assistance.

However, the doctor couldn’t rehabilitate himself and arrived at the scene and found that the flower had no heartbeat. At this time, Xu Wen, a team leader of the company's project department who heard the news, drove the flowers to the Donggou Hospital for inspection and was declared dead by the diagnosis.

After learning of the accidental death of her daughter, Xiao Zhang could no longer control her emotions and cried out loudly, then she went red eyes and went to the company's project department. Xiao Zhang and the couple cried, the drainage ditch in front of their house, which coincided with the annual dry season in winter, was almost waterless. However, after the construction of the project, in order to agitate the concrete to take water, a simple road was built at the west end of the drainage ditch, and the ditch was enclosed and dug a few meters deep as the water intake.

There were no warning signs on the road and there were no safety precautions. As a result of the company’s various violations, it led to the accidental death of flowers and requested compensation.

Recently, the Nanjing Liuhe Court held a hearing to hear the case. During the trial, the company argued that the ditch had already been formed before construction and was used for flood discharge in the flood season. It was usually used for villagers' agricultural production and domestic water use.

Even in the dry season, there is a certain amount of water in the ditch, which is enough to make a 4-year-old child drown. After opening up a temporary road, the company has buried culverts to facilitate drainage. Before the construction, the ditch had no so-called warning signs and safety precautions.

The court held that the behavior of the company has actually changed the original function and form of the drainage ditch, causing a large amount of rainwater to accumulate in the drainage ditch. It should assume the responsibility for the management of the construction site and fail to set security measures. The specific responsibility is 40%.

Xiao Zhang and Xiaoli, who were guardians of the Huahua, neglected their guardianship on the day of the incident and caused her to fall out of guardianship. When she was playing alone, she accidentally drowned and died. As a result, they were held responsible for guardianship. The specific responsibility was 60%. The judgment company made a loss of nearly 240,000 yuan.
